Darsean Kelley was tased by Colorado police for no reason. He knew his rights and said so. And it’s all on video.
Police got a call about a man pulling a gun on a kid. They had no description. They stopped two men near the location called in.
Darsean Kelly, one of the men, held his hands above his head as he questioned why they were stopped. Then the officer tased him in the back just as he said “I know my rights.” Darsean fell backwards and hit his head on the pavement. The officers had no reason to detain them.
They had done nothing wrong. Darsean was arrested and charged with “disorderly conduct.” The ACLU represented Darsean, and the prosecutor dropped the charges.
We all have the 4th Amendment right to be free from excessive and unreasonable force by the police.
